Acceptance

By using any Nothing But Tires (“Nothing But Tires”) related software, or by using or visiting the Nothing But Tires website, you agree to this Terms, Conditions and Privacy Policy (the “Terms of Use”). If you do not agree to any of these terms, please do not use the Nothing But Tires website or related software, or E-Commerce Site. These Terms of Use apply to all users, including users who are contributors of video content, information, and other materials or services on the website.

All use of this website is subject to the Terms of Use.

Access

Nothing But Tires hereby grants you permission to use the Nothing But Tires website in accordance with these Terms of Use, provided that:

Notwithstanding the foregoing, Nothing But Tires grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Nothing But Tires reserves the right to revoke these exceptions either generally or in specific cases. The website may permit the submission of videos or other communications submitted by you and other users (“User Submissions”) and the hosting, sharing, and publishing of such User Submissions. Nothing But Tires may also establish categories for User Submissions based on intended use, such as “Private” where User Submissions are not shared, “Invited” where there is an invitation to view, share, or both, and “Public”. You understand that whether or not such User Submissions are published and regardless of category, Nothing But Tires does not guarantee any confidentiality with respect to any such submissions.

You are solely responsible for your own User Submissions and the consequences of posting, sharing, or publishing them. For all User Submissions you submit which are intended for public use, you represent and warrant that:

you own or have the necessary licenses, rights, consents, and permissions to use and authorize Nothing But Tires to use all copyright, trademark, trade name, service mark, logos and intellectual property and other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the website and these Terms of Use; and

Nothing But Tires will remove all content and User Submissions if properly notified that such content or User Submission infringes another’s intellectual property rights. Nothing But Tires also has sole discretion to decide whether content or a User Submission is appropriate and complies with these Terms of Use. Nothing But Tires reserves the right to remove content and User Submissions without prior notice and to terminate your access to the website, if you are in violation of these Terms of Use.

Nothing But Tires reserves the right to discontinue any aspect of the Nothing But Tires website at any time.

Security of personal information

Nothing But Tires will take commercially reasonable steps to protect your personal information from unauthorized access, use or disclosure. Reasonable steps include physical, electronic and procedural measures appropriate to the level of sensitivity of the personal information, such as restricted access to records, password-protected systems and staff training.

No method of storing or transmitting information is completely secure. If a privacy breach creates a real risk of significant harm to you, we will notify you and Alberta’s Information and Privacy Commissioner as PIPA requires.

Video surveillance

We use security cameras in our shop, and signs are posted. Recordings are used for security, to investigate incidents and to protect vehicles and property. Recordings are kept for approximately 30 days unless needed for an investigation, and are disclosed only to police or insurers, or as required by law.

Job applicants

We use information from job applicants only to evaluate applications. Unless you are hired, we keep it for 12 months after the position is filled and then securely destroy it.

Access to personal information

You may access your personal information held by Nothing But Tires, including how it has been used and to whom it has been disclosed, to confirm its accuracy or completeness or to update your personal information, by sending a written request to the Privacy Officer, named above.
Nothing But Tires will correct or update any inaccurate or incomplete personal information upon request, at no charge.
Nothing But Tires reserves the right to charge a person requesting access to their personal information a reasonable fee for doing so where the costs of providing access are significant, and will provide a written estimate of the fee in advance.
We will respond within 45 days, or tell you if we need more time and why. In limited cases PIPA allows or requires us to refuse access; if so, we will explain why.

Response to Inquiries and Complaints

Nothing But Tires has established the position of privacy officer (“Privacy Officer”), responsible for the development and implementation of all necessary rules and procedures for the collection, use, disclosure and retention of personal information. The Privacy Officer shall ensure compliance with this privacy policy and all applicable privacy legislation. Questions concerning this policy should be brought to the attention of the Privacy Officer. The Privacy Officer will investigate and respond to all customer complaints in regard to the treatment of their personal information at the earliest opportunity. If the complaint is found to be justified, the Privacy Officer will so inform the customer and ensure that appropriate corrective measures are taken.

Applicable Law and general provisions

The Nothing But Tires website (excluding linked sites) is controlled by Nothing But Tires from within Alberta. By accessing the Nothing But Tires website, you agree that the statutes and laws of Alberta shall apply to all matters relating to, arising from or incurred by use of this website, and that Alberta courts shall have exclusive jurisdiction. You agree that any cause of action in relation to the website must be commenced within one (1) year after the cause of action arises, or such cause of action is permanently barred.

You confirm that you are either at least 18 years of age, or possess legal parental or guardian consent, and are fully able to enter into the terms, conditions, obligations, representations, and warranties described in these Terms of Use, and to abide by and comply with them.

Terms and Conditions of Sale:

Wheels are not included in the purchase of our tires

INSPECTION:

All of our tires are inspected visually, air/water tested as well as inspected before shipping. We do have a standard 30 day warranty on every tire we sell.

PLUGS/PATCHES:

Tires may contain plugs/patches – either existing or placed in the tire by us. We are an environmentally friendly business and do our best to be able to help the environment by returning tires back to safe use. If a plug/patch was not seen and is required in the tire Nothing But Tires will not cover the cost of installing one.

AGE:

Nothing But Tires does not record the DOT of tires. Our extensive knowledge, as well as experience, has shown us that how the tires are kept is more important. We keep all of our tires indoors in a heated facility free of outside conditions that can slowly degrade the quality of tires. Blemishes, scuffs, slight imperfections and slight weather-cracking may be present on our tires. These are deemed superficial and are not cause for warranty replacement or unsafe for use “Older model show cars still have the original whitewall tires on them and are kept indoors to maintain their quality”

MATCHED SETS:

We are firm believers in being thrifty as well as safe. Matching different brands and models (even for an AWD) is a trained and encouraged practice at Nothing But Tires. There are plenty of brothers and sisters to many brands that are almost identical in tread, traction, handling and performance. The only difference is the sidewall says a different brand. We do understand that some shops do not practice this however if this is the case we suggest talking to other businesses that endorse and encourage this practice of being both economical as well as environmentally responsible.

ALL SALES ARE FINAL Warranty:

A Thirty-day limited warranty is offered for a damaged or defective tire. Warranty includes a replacement of equal value or in-store credit at our discretion. Full refunds will not be given. Non-transferable credit. If it is decided to give a refund for any reason there is a 15% restocking fee (Minimum $50). Exceptions on partial refunds will be given at the owners’ discretion to guarantee the ongoing success of the business and customer satisfaction. Discretionary Refunds: It is at the discretion of the store on whether to offer a refund or not based on the type of damage or defect that is encountered. If the defect or damage is thought to have been done by the installation or use of the tire a refund will not be given. Liabilities: Nothing But Tires is not liable for any injury, death or damage to property from the use of our products. Once the tires leave the store all liability rests on the purchaser or the shop who places the tire on the vehicle. Tread Assurance: While all effort and experience is used to correctly gauge the tires we do not guarantee the 100% accuracy of the tread amounts which is also why the 32nds of the tire are shown on our listing.
